New export rules tighten shipments of advanced AI accelerators

Updated export rules published this week tighten the conditions under which advanced accelerators may be shipped abroad, replacing a single performance threshold with a pair of tests that consider both raw throughput and the density of interconnect between chips.

The change closes a gap that had become obvious over the past year. Designers had responded to the previous threshold by producing parts that fell just under it on paper while delivering most of the practical performance when deployed in large clusters, where the bottleneck is rarely a single chip.

What the new tests measure

The first test remains a computational-performance figure. The second, and the more consequential one, measures the bandwidth available between accelerators in a rack. Training a large model is a communications problem as much as an arithmetic one; a cluster whose chips cannot talk to each other quickly enough will sit idle regardless of how fast each individual part is.

By pairing the two, the rules make it harder to design around either. A part that scores under the compute threshold but well above the interconnect threshold is now captured, and vice versa.

Licensing, not prohibition

Most of the affected trade is not banned. It requires a licence, reviewed case by case, with a presumption of approval for some destinations and of denial for others. That distinction matters commercially: a licence requirement adds months of lead time and legal cost, and it makes revenue from affected regions difficult to forecast, but it does not eliminate the market.

The compliance burden lands downstream

The hardest questions are not for the chip designers, who employ large export-control teams, but for the companies further down the chain: system integrators, colocation operators and the smaller cloud providers who rent capacity without always knowing what runs on it. Their obligations are new, and the guidance addressing them is thinner than the rules themselves.

Export control has moved from a question about what you ship to a question about what your customer’s customer does with it.
